State hygienic regulation and registration of substances, materials, food, industrial products
In accordance with the Law of the Republic of Belarus “On the Sanitary and Epidemic Welfare of the Population”, chemical and biological substances produced in the Republic of Belarus and purchased for import, materials and products made of them, which pose a potential danger to human health, as well as production -technical purposes, goods for personal (household) needs, including food.
The requirements apply to legal entities and individual entrepreneurs.
The list of chemical and biological substances, materials and products from them, products for industrial purposes, goods for personal (household) needs, food products (hereinafter products) subject to state hygienic regulation and registration is approved by the Ministry of Health of the Republic of Belarus. Hygienic requirements for the production, use and sale of certain types of products are established by special sanitary rules and norms.
On the territory of the Republic of Belarus there are certificates of state hygienic registration of the Republic of Belarus, which confirm the safety for human health of products during its manufacture (supply), sale and use. The supply, sale and use of products manufactured outside the Republic of Belarus, which may pose a potential danger to human health, is allowed if there are documents proving its quality and safety for human health, and in accordance with sanitary rules.
The certificate of conformity of the Republic of Belarus issued for products subject to state hygienic regulation and registration is not a document certifying the state hygienic registration if it does not contain the number of state hygienic registration of products and its validity period, as well as if the validity of the certificate of conformity exceeds the validity period of the state hygienic registration of products.
The information specified in the certificate of conformity is confirmed by a valid certificate of state hygienic registration, either by a copy certified in accordance with the established procedure, or by a certificate of product registration in the State Hygienic Register of the Republic of Belarus and stored in the body that issued the certificate of conformity.
Foreign documents on hygienic registration (hygienic certificate, sanitary and epidemiological certificate, certificate of state registration and other documents) issued in countries with which the Republic of Belarus has agreements on the mutual recognition of these documents should be reissued for a certificate of state hygienic registration of the Republic of Belarus .
State hygienic regulation and registration of domestic products is carried out on condition that the production meets the requirements of sanitary and epidemiological legislation and eliminates the possibility of its adverse effects on human health, which is indicated in the sanitary and hygienic conclusion of the territorial center of hygiene and epidemiology on production.
The manufacturer of the products of the Republic of Belarus is obliged to ensure the production laboratory control of manufactured products according to indicators established by sanitary standards, rules and hygienic standards. The frequency and volume (nomenclature) of laboratory tests is agreed with the territorial bodies of state sanitary supervision and is carried out no less than is provided for in the normative documentation for products.
The manufacturer (supplier, seller) of products is obliged to provide reliable and necessary information about the products in the documentation attached to the product (consumer packaging, label, etc.), in Belarusian or Russian.
The information should contain the following information:
designation of the normative document, the requirements of which the products must meet (for products manufactured under the normative document);
information on the main consumer properties, and in relation to foodstuffs on the composition, nutritional value, an indication that the product is genetically modified or not;
indications (contraindications) for use;
expiration date (deadline for implementation);
operating conditions (consumption), storage, date of manufacture;
name of manufacturer with legal address;
other information in accordance with applicable law.
For the quality and safety of products, the reliability and effectiveness of the declared properties of products, advertising of manufactured (supplied) products is the responsibility of the manufacturer (supplier) in accordance with the legislation of the Republic of Belarus.
The documents confirming the state hygienic regulation and registration of products sold (supplied) and used in the production (in the provision of services) in the territory of the Republic of Belarus are:
a certificate of state hygienic registration of the Republic of Belarus issued by the Ministry of Health of the Republic of Belarus or authorized bodies and institutions of the Ministry of Health of the Republic of Belarus and executed on a special color protected form of strict reporting and approved form or a copy certified in the established manner;
for products subject to mandatory certification - a certificate of conformity of the Republic of Belarus or a copy thereof certified in the prescribed manner, which contains information on state hygienic registration (state hygienic registration number of the product and its validity period).
The documents certifying the quality and safety of products issued by the manufacturer of the Republic of Belarus shall indicate:
state hygiene registration number;
number of the certificate of state hygienic registration, its validity and the institution issuing it.
The above information can be applied on consumer packaging, label.
Certificates of state hygienic registration and their copies must be presented by legal entities and individual entrepreneurs engaged in the sale of products, at the request of consumers, public organizations of consumers, regulatory authorities.
Certificates of state hygienic registration and their copies are kept by legal entities and individual entrepreneurs for at least one year after the expiration of its validity.
According to the results of inspections carried out in accordance with the state sanitary inspection, or in cases of receipt of information about complaints about product quality and product health safety from consumers, the fact of registered products non-compliance with sanitary norms, rules and hygienic standards, the Chief State Sanitary Inspector of the Republic of Belarus or his Deputy (in case of issuing a certificate of state hygienic registration by the territorial center of hygiene and an epidemiologist ii - the Chief State Sanitary Doctor of the corresponding administrative territory or his deputy) have the right to cancel the certificate of state hygienic registration, or to suspend its effect and appoint a repeated hygienic examination of the products. Accordingly, the production (sale) or use of the products for which the certificate was issued must be stopped or suspended.
